2. Cookies and Trackers

As many other websites, we use ” cookie ” technology to gather additional information regarding the usage of the site to optimize the services. A cookie is a little data file which we transfer to the hard drive of your computer. We are not using cookies to collect any personally identifiable information. We may store cookies on your computer for various time periods. Quilly can use both session cookies and permanent cookies to understand how you engage with the services better, to track overall utilization by our users and routing of browser traffic on the services, to deliver promotions on the services that are customized to meet your preferences, and to improve the services. A session cookie allows certain functionalities of the website and our services and will be cleared from your computer when you disconnect from or exit the website. A permanent cookie remains after you close your browser and can be used by your browser on subsequent visits to the website. Permanent cookies can be removed by following the guidance in your web browser’s help file. Most web browsers will automatically accept cookies. More details about cookies can be found in All about cookies.

You will be able to adjust your browser preferences to disable the cookie acceptance or to request you to accept a cookie from the websites you visit.

Please be aware that if you restrict website cookies, you might not be able to access parts of the services and the services may not work as they should.

Advertising platforms might use cookies to gather personal information. Many advertising networks offer you the ability to opt-out of targeted advertising. If you want to know more about this, please visit the Network Advertising Initiative’s online resources and read the opt-out information there. If you visit the website from your mobile device, you might not have the ability to control tracking technologies from the settings

Type of Cookies Used: The website makes use of the following technologies outlined hereafter.

Strictly Necessary Cookies. We use cookies which are strictly necessary to enable users to be able to enter the website and use certain features of it, such as being able to log in and gain access to safe areas. These cookies are crucial for the use and navigation of the website. Without those cookies, fundamental features of our website would not function. As these cookies are necessary for the operation of the website, users are not able to opt out of them.

Optional cookies. We use “analytics” cookies that enable us to track and count the amount of users who have visited the website, and to understand how visitors navigate around the site when they use it. This helps us enhance the functionality of our website, for instance, by assuring that visitors can easily find exactly what they need. Those cookies only give us anonymous traffic metrics (like the number of page visits), the amount of visitors, and the amount of the time spent on every page. These cookies also enable us to monitor how frequently people click on posts on third-party websites, for example, on social media. In the framework of using Google Analytics, optional cookies from Google are placed on our website. Google Analytics is a web analytics service offered by Google, Inc. (“Google”). Google Analytics utilizes cookies to understand how users are interacting with the Services. The cookie generated information regarding your use of the website (including your IP address) will be transferred to Google and saved by Google on their servers. This information will be used by Google to analyze your use of the services, to compile reports on website activity for us and to provide other services related to the use of the website and the Internet. Google might also transmit this information to third parties if it is legally mandated to do so or if third parties are processing this information on behalf of Google. If you want to know more about how Google Analytics gathers and makes use of personal data, please read the privacy policy, which can be accessed here: Google Privacy Policy. To deactivate detection by Google Analytics on all websites, visit http://tools.google.com/dlpage/gaoptout. By making use of the services, you agree to the data gathered about you being handled by Google in the previously mentioned manner and for the above-mentioned purpose. The website uses other analytics cookies which are provided by third parties and are similar to Google Analytics cookies, and also include links from the website to plug-ins (e.g. social media services) and websites or applications run by third parties. We do not have control over third party services and are not accountable for the collected information from them.

Your Choices: In most web browsers, you will find a “Help” section in the toolbar. In that section you can read about how to get a notification when you obtain a new cookie and how to deactivate cookies. See the links below for guidance on how to adjust your web browser preferences in the most common browsers:

  • Mozilla Firefox
  • Google Chrome
  • Microsoft Edge
  • Apple Safari

Please be aware that if you limit the ability of websites to place cookies, you might not be allowed to view certain sections of the website and you may not be able to use all the website’s functionality. If you visit the website from your mobile device, you might not be able to manage tracking technologies via the settings.

Do Not Track: We and our third-party partners, including Facebook, may employ cookies, pixels, or other tracking technologies to aggregate information regarding your browsing activity over time and across various websites after you have used the site, and to use this information to send targeted ads. We do not respond to “do not track” or other such mechanisms of web browsers currently. If we respond to “do not track” signals in the future, we will then update this Privacy Policy to outline how we do so.

All of these purposes also represent our legitimate interests, which we pursue with the processing of personal data associated with each of them. The legal basis is accordingly Art. 6 para. 1 p. 1 lit. f) DSGVO).

3. Information Sharing and Disclosure

Service Providers: We employ certain trusted third parties to conduct features and deliver services on our behalf, including, but not limited to, web hosting and maintenance. We will disclose your personal information to those third parties but limited to the amount required to conduct such functions and deliver such services, and only under binding contractual commitments that commit those third parties to maintaining the privacy and security of your information. In addition, we might use the information provided by you through third-party services to deliver the services, which might include accessing the third-party services you selected so that we can provide you with the information you requested. Regarding mobile applications or mobile versions of our websites, we might gather the unique device identifier that has been assigned to the device by phone manufacturers, network providers, or manufacturers of the operating system (the “Device ID”). Device IDs allow app developers, marketers, and others to clearly identify your device to store application preferences and other information. We make commercially reasonable efforts to ensure that our service providers comply with the security standards we apply to your personal information. We might use your device ID to provide security. For instance, if you have activated a function that limits access to a service from a certain device, our systems will be accessing the device ID from any device you try to use to gain access to the services to verify that the device is the authorized device. We might also use device IDs to track suspicious activities. For example, if we discover that a single account on a website is being visited from multiple devices, as identified by tracking the device IDs that are accessing an account, we might reach out to the user to verify that such access has been approved by the user.

Compliance with Laws and Law Enforcement: Quilly co-operates with government and law enforcement agencies or private parties to enforce and obey the law. We might provide information concerning you to government or law enforcement agencies or private parties as we, in our sole discretion, consider necessary or proper to comply with requests or legal processes (including subpoenas), to protect the property and rights of Quilly or a third-party, the security of the public or any individual, to prevent or stop illegal, unethical, or legally enforceable activities, or to obey the law.

Business Transfers: Quilly may sell, transfer or otherwise share some or all of its assets, including your personal information, in the context of a merger, acquisition, reorganization or sale of assets, dissolution, transfer of the service to a different provider, or in the case of bankruptcy.

Affiliates: Quilly may disclose personal information to our existing and future affiliates, which are entities that control, are under the control of, or are under common ownership with Quilly. Our affiliates may use the personal data we disclose in compliance with this Privacy Policy.

Other Users: Specific activities that you take may be available for other users of the services to see. For instance, your posts appear in other users’ feeds and your profile information is available to other users. You understand that by sharing posts or by adding any information to your profile, you are providing the shared information to other users and that Quilly has no control over, and is not responsible for, other users’ use of that information. We might post your content on our YouTube, Instagram, Facebook, Twitter, Medium, Vimeo, YouTube, or LinkedIn page.

Personal Information: Unless otherwise specified in this Privacy Policy, we do not sell, disclose, or provide your personal information to any third party for their marketing purposes without your permission. In association with third-party services, we might disclose some of your personal information to those third-party service providers to fulfill the transaction you have requested. We might disclose your personal information to third-party service providers so that they can support us in completing your requests or transactions that you perform through the sites, including the operation of specific site functions and services. Third parties who act on our behalf and obtain access to your personal data are required by contract to comply with our data protection principles and are not allowed to use the information for any other means. We reserve the right, in our sole discretion, to disclose or share your personal information with law enforcement agencies, government officials, and other third parties:

  • To reply to subpoenas, court orders, or legal processes;
  • To investigate, prevent, or take any other action concerning breaches of our Terms of Use, illegal activities, suspected fraud, or any situation that may pose a potential risk to the rights or physical safety of any person, or to the safety of our network, sites, or services;
  • Respond to allegations that a post or other content violates the third party rights;
  • In an emergency, to be able to protect the health and security of users of our websites or the public; or
  • To the extent necessary under applicable law.

We might disclose your personal information to other third-parties with your permission or at your instructions.

4. Advertising

Ad Serving: We might display ads in the services. Such ads may be provided to you by an internet advertising provider. To provide you with ads, we might make use of information gathered from your searches or visits to our sites, as well as information that we obtain specifically from third parties

Advertising and Cookies: Certain of our third-party advertising partners might place cookies in the ads served to us to users. Quilly does not access or have control over those cookies once we received the advertising. Some of those advertisers and services we use to provide ads may engage in online conduct-based ads as defined by the Digital Advertising Alliance and the FTC. For further details about the cookies we use, please see our “Cookies and Trackers” section above.

Affiliate Advertising: We engage in affiliate marketing and permit the use of affiliate links to be embedded on certain of our pages. That means we might receive a commission when you choose to click on or make purchases through affiliate links, and affiliates might have cookies used to understand your use of the services.
While Quilly will not disclose personally identifiable information to third-party advertisers, if an advertiser asks Quilly to show an advertisement to users with particular characteristics or a certain segment of that group (e.g., males aged 25-30 who have viewed specific content categories on the services), and you are responsive to that advertisement, the third-party advertiser might consider that you have the characteristics of the target audience it is seeking to address.

Opt-out: As part of our dedication to being transparent and ensuring your privacy, we will provide you with the following links that will provide you with the opportunity to opt-out of the use of cookies that are provided by both our first-party ad server and by many third-party advertisers that may be serving online behavioral advertising:

First Party Opt-out: Third-party and behavioral online advertising opt-out. Please follow this link to opt-out from cookies of more than 50 major behavioral advertising companies: http://www.aboutads.info/choices/.

Interest-Based Advertising Opt-out: We or third-party advertisers may display ads on the services that are customized to your interests based on the activities you engage in online or in the apps on your mobile device. This type of advertisement customization – sometimes described as “interest-based” or “behavioral” online advertisement – is powered by various technologies, including browser cookies, mobile advertising identifiers, and other non-cookie based technologies. Information we gather in compliance with this Privacy Policy can be used for interest-based advertisements and can be shared with our service providers or partners to deliver such customized advertisements. We and our service providers and partners can use cookies and information you enter when registering or otherwise when creating your profile, for example, the kind of investments you are most interested in. To opt out of interest-based advertisements, please visit http://optout.networkadvertising.org/#!/, which allows you to change your browser settings so that you will no longer be served advertisements that are tailored to your preferences.

You may need to respond to an initial message to finish your sign-up and validate your enrollment in the text service. By giving us your cell phone or other telephone number, you consent to Quilly and its affiliates to contact you at any phone number you have given us with automatic or pre-recorded calls and text messages in order to: (i) notify you concerning your account; (ii) resolve problems with your account; (iii) settle a dispute; (iv) collect a debt; (v) request your opinion through surveys or questionnaires; (vi) provide you with any updates, alerts, messages, and information for which you have subscribed; and (vii) as otherwise required to service your account or enforce the Terms and Conditions, our policies, applicable law, or any other agreements we have with you. In case you decide to change or inactivate your mobile phone number, you commit to promptly update your Quilly account information to assure that your messages are not sent to the person that takes over your old number.

5. Third Party Data Collection

We may provide a variety of different products and services that are offered by third parties and advertised to you on our website and through the services. These third-party offers may supplement your use of the website and may be customized based on information you have provided to us, information we have gathered about you, inquiries you may have made via the website, or any other information. If you decide to use those separate products and services, provide information to the third-party, or otherwise permit the third-party to gather any information about you, then the use of your information will be covered by that third-party’s privacy policy and terms of use. You are encouraged to check the third party’s practices before agreeing to use their services, provide information to us about the third party, or give them any information. Keep in mind that Quilly is not responsible for the privacy policies or practices of any third party.
You are also advised to be aware that certain content delivered through the services is from third party providers. These third-party content providers might place cookies on your computer or otherwise gather some information about you, for instance, by asking you to enter some information about the content provider itself. We encourage you to read the Terms of Use and Privacy Policies of the creators of such content.
